Cii’s Professional Service Partner Mason Hayes & Curran has kindly provided a briefing note on the The Gaming and Lotteries (Amendment) Act 2019. The briefing covers lotteries (which includes raffles, draws, sweepstakes and bingo) and will prove useful to charities as it clarifies points on prize totals, permits and licenses, and periods of validity.
Briefing
The Gaming and Lotteries (Amendment) Act 2019 (the “2019 Act”) came into effect on 1 December 2020 which amended the Gaming and Lotteries Act 1956 (the “GLA”). The main aims of the 2019 Act are to:
• Streamline and modernise the application process for gaming permits and lottery permits and licences for smaller scale, local gaming and lottery activity.
• Protect underage people by standardising the minimum age for all licensed gambling at 18 years of age.
• Ensure more proceeds from lotteries go to charitable causes.
• Update the stake and prize limits for licensed gaming machines, with a provision for the Minister to amend the amounts by regulation.
• Serve an important public interest in assisting the better promotion of gaming and lotteries and enhance consumer protection.
We outline the significant changes introduced by the 2019 Act, including in relation to: (1) lotteries; (2) gaming; (3) age limits; and (4) enforcement. Appendix One sets out in detail the lottery and gaming key elements.
